0. Purpose
This Terms of Service (TOS) Policy establishes the contractual principles governing access, use, and participation within the Seacrets digital platform, operated by Hyper Lab LLC. It aligns operational and legal expectations across all users, creators, and third-party providers while ensuring compliance with global adult-industry, privacy, and content-regulation standards.
Seacrets adopts a cross-jurisdictional compliance framework based on:
- EU Digital Services Act (DSA)
- U.S. FOSTA–SESTA
- COPPA (Child Online Privacy Protection Act)
- Visa / Mastercard adult-content rules
- AML/CFT regulations applicable to digital platforms
This Policy aims to:
- Establish rights and obligations between Seacrets and all categories of users.
- Guarantee a safe, transparent, and lawful environment for accessing and monetizing content.
- Promote responsible and compliant usage of all services offered through the Seacrets ecosystem.
1. Acceptance and Scope
1.1 User Acceptance
By creating an account or interacting with Seacrets, the user (“User”) certifies that they:
- Are at least 18 years old, or above the age of majority required in their jurisdiction.
- Possess the legal capacity to accept these TOS.
- Access the platform from a location where viewing explicit content is legal.
1.2 Applicability
The TOS apply to all Seacrets services, including:
- Official website and subdomains
- Mobile apps
- API integrations
- Live-streaming and interactive features
They govern all roles:
- Creators (verified users uploading or monetizing content)
- Fans/Consumers
- Authorized third-parties (payment processors, moderators, business partners, technological providers)
1.3 Supplemental Documents
By agreeing to the TOS, the User also accepts the following binding documents:
- AML Policy
- KYC Policy
- Parental Control Policy
- Chargeback Policy
- Non-Consensual Content Policy
- Acceptable Use Policy
- Privacy Policy
- Complaints Policy
- Information Security Policy
- Digital Ethics & Conduct Code
Updates will be published and notified when material changes occur.
2. Key Definitions

| Verified Creator | A user who has completed identity checks, age verification, and documented consent requirements for all persons featured. |
| Proactive Moderation | Hybrid (AI + human) monitoring measures to detect, block, or review content before and after publication, including hash-matching, age estimation, keyword filtering, and contextual review. |
3. Guiding Principles
3.1 Legality & Transparency
Seacrets complies with major global regulatory frameworks including:
- EU DSA
- 18 U.S.C. §2257 recordkeeping requirements
- Visa/Mastercard adult-content compliance programs
All platform actions are documented, auditable, and traceable.
3.2 Consent, Non-Coercion & Minor Protection
Zero tolerance for:
- CSAM
- Non-consensual content
- Coercion, impersonation, or unauthorized simulated likenesses
All content featuring a person must have verifiable, documented consent.
3.3 Privacy & Security by Design
Seacrets implements:
- Encryption of data at rest and in transit
- Minimal retention standards
- Segmented access controls
- ARCO rights and GDPR-aligned deletion mechanisms
3.4 Creator Due Diligence
For every creator:
- Full KYC (biometric + document validation)
- AML/CFT screening
- Compliance with 18 U.S.C. §2257 recordkeeping
3.5 Proportional Moderation
Moderation balances freedom of expression with platform safety obligations and includes:
- AI filters
- Human review
- Appeals mechanisms
- Rapid removal protocols
4. Acceptable Use Rules
Users shall NOT engage in the following behaviors:
4.1 Intellectual Property Infringement
Uploading, sharing, or selling content without proper rights or licensing.
4.2 Prohibited Content
Strictly forbidden:
- CSAM (real or simulated)
- Bestiality, necrophilia, incest
- Extreme violence or non-consensual acts
- Sexual deepfakes without consent
4.3 Privacy Violations
Doxing, extortion, sextortion, or exposing private data.
4.4 Security Evasion
Bypassing age verification, KYC, or geoblocking controls.
4.5 Illegal Use
Using Seacrets to promote or facilitate:
- Prostitution
- Human trafficking
- Illegal sexual services
- Fraud or financial crime
5. Verification & Recordkeeping

Seacrets maintains a robust identity, consent, and documentation system.

6. Moderation, Reporting & Escalation
All user generated content will be reviewed/pre-screened before being published.
6.1 Pre-Publication Moderation
AI-driven scanning (hash checks, CSAM detection, StopNCII integration).
6.2 Post-Publication Moderation
- Ongoing sampling every 6 hours
- Community reporting button in each post
6.3 Trusted Flagger Workflow
Priority channel for NGOs and government agencies with ≤24h response time.
6.4 Complaints & Appeals
- Initial resolution: ≤7 business days
- One appeal handled by an independent team
- Reasoned notification of outcome
6.5 Progressive Enforcement
- Warning
- Demonetization
- Temporary suspension
- Permanent ban
- Mandatory reporting to LEA for CSAM, trafficking, or exploitation
7. User Rights & Obligations
7.1 Content License
Creators grant Seacrets a non-exclusive, transferable, sublicensable license to store and distribute content while account is active.
7.2 Commission Fee
Seacrets applies a 20% platform fee.
Withdrawal rules:
- Minimum withdrawal: USD 50
- Funds available 7 days after transaction
- All payouts require KYC/AML completion
7.3 Privacy Rights
Users may request:
- Access
- Rectification
- Data portability
- Deletion (“right to be forgotten”) except where law mandates retention
7.4 Account Closure
- Users may close accounts anytime
- Data retention:
- 180 days (general users)
- 7 years (creators, for 2257 compliance)
8. Limitation of Liability
8.1 Exclusion of Indirect Damages
No liability for:
- Loss of profits
- Loss of opportunities
- Data breaches caused by user negligence
- Fraud or misconduct between users
8.2 Exception: Gross Negligence or Intent
Seacrets remains liable only under statutory mandates.
8.3 Liability Cap
Maximum liability: fees paid by the User in the preceding 12 months.
8.4 Content that Risks Life or Safety
Seacrets may suspend or delete such content immediately and notify authorities.
9. Regulatory Compliance & Cooperation with Authorities
9.1 LEA Requests

9.2 DSA Transparency
Seacrets publishes biannual transparency reports covering removal actions, moderation metrics, and trusted flagger performance.
9.3 Geoblocking & Sanctions
Access is restricted based on OFAC, EU, UK, and other sanction lists.
10. Changes & Versioning
Updates notified 15 days in advance. Continued use = acceptance.
